On December 5, 2020, the Depart Of The Environment issued a Notice of Intent to remove 22 living organisms from the Domestic Substances List (DSL).
The 22 organisms include Alcaligenes species, Alteromonas species, Pseudomonas species, Bacillus species, Flavobacterium species, Micrococcus species, Thiobacillus species, Cellumonas species, Enterobacter species, Nitrobacter species, Nitrosomonas species, and Rhodopseudomonas species.
All 22 organisms were nominated to the Confidential DSL in 2010 under the criteria of the Canadian Environmental Protection Act (CEPA) Section 105;
- i) that the organisms were in commerce in Canada between January 1, 1984, and December 31, 1986, and
- ii) had entered or were released into the environment without being subject to conditions under CEPA, any other Act of Parliament or of the legislature of a Province.
However, on review, it has been determined these 22 organisms do not meet the requirements of CEPA Section 105.
Should these organisms be removed from the DSL, any person wishing to manufacture or import the organism(s) will be subject to the reporting and compliance requirements of the New Substances Notification Regulations (Organisms).
Any comments or substantiating documentation to demonstrate that the living organism(s) proposed for deletion meet the criteria prescribed in subsection 105(1) may be submitted by February 3rd, 2021.
