
Pre-Consultation Notice to Amend the Cosmetic Regulations within Canada

Health Canada advised Canadian interested parties last week about the intention to amend the existing Cosmetic Regulations. Health Canada will provide a 45-day comment period starting on July 16th through till August 30, 2021. Information regarding the actual proposal and instructions for submitting your comments can be found here.
To participate in the pre-consultation, they ask that you send them an email to: hc.cosmetics.sc@canada.ca to express your interest and to request a comment package from them. They will then email you a copy of the “Notice to Interested Parties” and instructions on how to provide your comments.
Health Canada has advised that the main objective of this initiative is to better inform consumers about the presence of specific fragrance allergens within cosmetics that are currently captured on cosmetics under the word ‘parfum’.
They are considering the following amendments:
- Add a requirement to disclose specific fragrance allergens on labels of cosmetic
- Allow flexibility for the disclosure of ingredients and specific fragrance allergens on labels of small packages
- Improve oversight of cosmetics by: clarifying terminology and improving the level of detail for information submitted in a cosmetic notification, in order to facilitate its use for risk management purposes; enhancing compliance and enforcement oversight with regard to who is responsible for responding to evidence of safety requests for cosmetics; and
- Address administrative updates.
