PMRA Annual Charges Fee Proposed Updates

On January 31, 2024, Health Canada’s Pest Management Regulatory Agency (PMRA) proposed significant amendments to the Pest Control Products Fees and Charges Regulations, aiming to update the annual charges associated with pest control product registrations. These changes are designed to better reflect the current costs of post-market regulatory activities and to align more closely with international standards.  

Current Fee Structure 

As of now, the annual charge for each pest control product is determined based on its gross sales revenue. Products with sales exceeding a specific threshold incur a standard fee, while those below may qualify for reduced rates. This sales-based model has been in place for several years.  

Proposed Changes 

The PMRA proposes shifting from the current sales-based approach to a tiered fee structure based on the number of product registrations held by a registrant. The key elements of the proposed amendments include: 

• Tiered Annual Charges: 

• • Registrations 1–2: $6,130 per registration 

• • Registrations 3–25: $4,598 per registration 

• • Registrations 26–75: $5,211 per registration 

• • Registrations 76 and above: $5,517 per registration 

• Fee Reductions: 

• • Small Businesses: Registrants with fewer than 100 employees and less than $5 million in annual gross revenues would pay a reduced fee of $2,000 per registration. 

• • Biopesticides: Products classified as semiochemicals, microbial agents, or non-conventional pest control products would incur a reduced fee of $1,000 per registration. 

• • Niche Products: Certain specialized products, such as those used on low-acreage crops or in public health programs, would also benefit from a reduced fee of $1,000 per registration. 

• Exemptions: 

• • Government Registrations: Products registered by federal, provincial, or municipal government departments or agencies would be exempt from the annual charge. 

• • New Active Ingredients: A three-year fee exemption is proposed for new active ingredients and their associated end-use products that have not been previously registered. 

Rationale Behind the Changes 

The PMRA’s analysis revealed that the current fees do not adequately cover the costs of post-market regulatory activities, leading to an increased financial burden on taxpayers. The proposed amendments aim to establish a more equitable cost-sharing model between the public and private sectors, ensuring the sustainability of Canada’s pesticide regulatory system.  

Next Steps 

The PMRA plans to finalize the proposed amendments after considering stakeholder feedback. The new fee structure is expected to be implemented in April 2025, with the updated fees appearing on the 2026 PMRA invoices.
