WHMIS 2015 and Confidential Business Information (Trade Secrets)

As part of the ongoing transition into WHMIS 2015 (GHS) as of June 1st, 2016 Health Canada will only accept Supplier Claims for Exemption under the Hazardous Materials Information Review Act (HMIRA) and Hazardous Materials Information Review Regulations (HMIRR) that use Safety Data Sheets and Labels compliant with the Hazardous Products Regulations (aka WHMIS 2015). A Claim for Exemption under the HMIRA/HMIRR is an exemption from the requirement to disclose specific chemical identity, CAS# or concentration of a hazardous ingredient on the Safety Data Sheet.

A supplier is defined as the manufacturer or Importer of a Hazardous Product.
